SpeedPay Global Financial Technology Limited (the "Company") is committed to comply with the Personal Data (Privacy) Ordinance (Chapter 486 of the Laws of Hong Kong), the relevant guidelines and codes of practice issued by the Office of the Privacy Commissioner for protecting the Personal Data (Privacy), and our Company's policy on the protection of personal data (collectively referred to as the Privacy Ordinance and Policy). Our Company will ensure that strict standards of security and confidentiality are observed by its employees.
Our Company will collect and retain personal data related to customers in connection with the application, continuation, use and redemption of products and services
The purposes for which our Company may use data related to customers are:
(i) to consider and process applications for products and services;
(ii) to ensure your continued good reputation;
(iii) to provide and process the day-to-day operations of services, including but not limited to customer service, transaction and balance enquiries, merchandise purchases and ATM withdrawals;
(iv) to design financial services or related products for the use of customers;
(v) to fulfill the obligations of information disclosure and usage under relevant laws and guidelines issued by financial regulatory agencies or industry organizations within and outside Hong Kong;
(vi) to assist in the prevention, scouting or investigation of crime or potential criminal activities;
(vii) to assist in resolving disputes related to transactions.
We will contact the cardholders through phone number, address, email or other means provided by the cardholders and they must notify us immediately if they changes any information.
Depending on the products and services you applied for/purchased, as well as in certain circumstances, we may collect and retain a range of different information about you in order to provide you with products and services and due to the reason of the purposes and use of personal data as set out in the "Main Purposes of Retention". Personal data includes, but is not limited to, the following information and relevant copies where applicable:
(i) your full name, date of birth, gender, nationality, identity card number registered on your personal identification document (e.g. identity card, travel document);
(ii) your contact details including name, phone number, email address, residential address, and postal address;
(iii) information about the use of products and services, such as purchase and cash withdrawal transactions.
Providing us with your personal data is optional. However, if personal information is required to approve and/or process your application/purchase of products and services, failure to provide the required personal information may result in us being unable to provide you with the relevant products and services.
By purchasing or using a SPEEDPAY card, the cardholder consents to the collection and use of the cardholder's personal information by us and third parties in accordance with these terms and conditions. At the same time, it means that the Cardholder authorizes us to make any enquiries, either directly or through a third party, that we consider necessary to verify and/or authenticate the Cardholder's identity and information, including but not limited to (i) obtaining the Cardholder's identification documents, personal/company information and other relevant information and/or documents, (ii) verifying the authenticity or ownership of the Cardholder's email address, phone number, bank account, and (iii) making enquiries to the third party's database or (iii) obtaining and verifying the cardholder's identity and information from third party databases or other sources of information.
By confirming the purchase or use of a SPEEDPAY Card, the Cardholder agrees that our Company may submit his/her personal data to Hong Kong and/ or oversea regulatory authorities and the Cardholder's personal data may be used by the relevant regulatory authorities.
The Cardholder's personal data will be collected, used, processed and stored by our Company and it will be collected and submitted to our Company by our Company's authorized sales agents or co-branded partners on behalf of our Company. Our Company and authorized sales agents or co-branded partners will keep the Cardholder's personal data confidential in accordance with the Privacy Ordinance and policies. The channels through which our Company collects personal data include but are not limited to:
(i) directly from customers;
(ii) from third parties, such as brand partners;
(iii) publicly available sources of information; and
(iv) records of our customers' use of our products and services.
Unless otherwise specified, our Company will not collect any personal, identifiable information from visitors to the Website. Only the IP address of the visitor and the pages visited by the visitor will be recorded. This information will be used to prepare aggregate information about the number of visitors to the site and general statistics about site usage patterns.
Our Company is committed to protect all personal data, including allowing access to information only by authorized employees and allowing access to personal data for the purposes set out in this statement "Primary Purposes for the Retention and Use of Personal Data", providing high security storage facilities, and implementing security measures for data storage equipment. Encryption technology will be used to protect sensitive personal data during data transmission process. If our Company engages a data processor to process personal data on our behalf (whether in or outside of Hong Kong), our Company will use contractual or other means to prevent unauthorized or accidental access to, processing of, deletion of, loss of or use of personal data to the data processor.
Customer personal data shall not be retained longer than the time required to achieve the purposes for which the personal data was collected or to comply with legal, regulatory and accounting requirements from time to time. When data retention is no longer necessary in accordance with the above criteria, we will destroy your personal data in our data storage system in accordance with our internal policies.
Personal data held by us will be kept confidential, but we may disclose your personal data to parties outside of SpeedPay Global Financial Technology Limited (within or outside Hong Kong) for the "primary purpose of storing and using personal data.
Unless prohibited by law, we transfer, disclose, process and store your personal data to our holding companies, subsidiaries, representative offices, agents and other third parties designated by us (hereinafter referred to as transferees), who may be located at locations other than the point of purchase, including Hong Kong and/or outside Hong Kong, and the cardholder's personal data will be used in accordance with the Privacy Ordinance and the Policy. Except as provided below, the transferee will only use the Cardholder's personal data for internal purposes (such as data processing, statistics, credit and risk analysis), and our Company will enter into a contract with the transferee to require the transferee to take reasonable and prudent measures to keep the Cardholder's personal data confidential, and to comply with the laws and privacy ordinances and policies of the transferee's location.
Our Company and any assignee may disclose the Cardholder's personal data to third parties for the following reasons.
a. the provision of services, products or the advertising and promotion of products to cardholders;
b. anti-money laundering and counter-terrorist financing;
c. crime detection and fraud prevention;
d. disclosure required by any law, court, regulatory body, law enforcement agency or legal process in Hong Kong or other overseas jurisdictions.
Cardholders have the right to request access to their personal data held by our Company and we will handle all data access and correction requests in accordance with the provisions of the Ordinance. Our Company may charge a reasonable fee to fulfil individual data access requests in accordance with the Ordinance. The request for accessing and correcting data can be submitted to the data protection officer of our company.
The cardholder agrees that our Company and other related parties may contact the cardholder for information on the provision of relevant products and services. If the Cardholder does not wish to receive promotional information about SPEEDPAY, the Cardholder may raise this to our Data Protection Officer.
